Drafting A Will To Make Your Wishes Known

More than half of American adults do not have a will. That’s for rich people. That’s for old people. My family knows what to do.

None of those reasons are valid. You have more assets than you realize. People of all ages die unexpectedly. And even if your family members did know your wishes, that’s not how the law works.

Why Do I Need A Will?

That is best answered by explaining what happens without a will. If you passed away with no written will recorded, your estate would be divided according to the Virginia laws of intestacy. Your intentions would not be honored (even if you made verbal assurances to family members), and some of your assets might instead go to the wrong people. The resulting resentments and disputes are not what you want your legacy to be.

A last will and testament can make your wishes clear regarding:

  • Who should inherit
  • What part of your estate each heir shall receive
  • Preferred guardians for your minor children
  • Funeral rites and disposition of your remains
  • Care of your pets
  • Bequests to charity in your name

In conjunction with a will, we can also create powers of attorney and a health care directive (living will) to guide your loved ones and doctors if you become incapacitated.
